At Guenin Law, we have handled wrongful death cases that have involved experts from Colorado, California, Virginia, Kentucky, Florida, Pennsylvania, Idaho, Illinois, and Texas, as well as throughout Indiana. Sometimes the best expert is located thousands of miles from where your loved one was killed. We know how to get that expert in touch with the evidence.
-
Once the investigation is complete, we don’t stop. We bring the evidence together. We present the evidence to the insurance company for the person or corporation at fault. We show them with evidence why its insured should be held accountable for the death.
-
We tell them the story of your loved one. What their life meant to their family, to their friends, to their neighbors, and to their community. Why money should be paid to compensate for the harms and losses suffered.
-
This is not easy. Insurance companies often look for excuses not to pay for the damages, not to pay for the losses. People do not always step up and do what is right. Insurance companies will sometimes say that no amount of money can bring the loved one back from the dead, so the insurance company claims they should not have to pay a dime in compensation, or only a few dollars. This is wrong. The law establishes the different damages that should be paid when a loved one is killed.
-
It is our job to make sure the insurance company does its job. That is what we do.
-
Our knowledge of every legal element of damage payable for the loss of your loved one and our experience in finding the best way to tell your loved one’s story to a Judge or Jury or to an insurance claims adjuster helps to maximize the recovery for your loss whether at mediation or at trial.
-
When you are pulled into dark places by the death of your loved one, you need someone that will help – someone who knows how to help you find your way out of the darkness, someone who will hold those responsible, accountable for their actions. You need Guenin Law.
Insurance Problems
-
Whether you're a business owner or a driver, insurance claim denials can severely impact your day-to-day operations. If not handled swiftly and appropriately, the effects could be catastrophic.
-
Insurance disputes and problems happen at the worst possible times. Most of us are fortunate enough that we do not have to make a claim against our insurance policy, but we all know problems happen. The reason we plan and budget and make paying our insurance premiums a priority is because we are trying to protect what we have worked so hard to get. Then when tragedy strikes, our claim is denied or only partially approved. Now our suffering is multiplied.
-
On top of the original loss – the one we thought we were insured for – there is a second loss – a denial of coverage. These losses are compounded by the fact that the agent that sold us the insurance policy is often prohibited from handling our claim. Instead, we receive phone calls and emails from a stranger identified as an insurance adjuster or “claims specialist” telling us about all of the hoops we must jump through and hurdles we need to clear before the insurance company will even consider our claim. They tell us that we don’t need a lawyer and that IF the insurance company pays anything at all, it will pay only a fraction of the amount we paid for under the terms of our policy.
-
This can be a very confusing time. Insurance policies are extremely complex. Most policies are numerous pages with several separate endorsements, exclusions, restrictions, and exceptions to the exclusions. The policies contain technical jargon, complicated legal terms, and paragraphs that seem to conflict with other terms of the policy. The policies are confusing.
-
Headaches, shattered nerves, and that sick feeling in your stomach all add to the problems already suffered. A stack of papers that were written by the insurance company have to be analyzed. This is when you need Guenin Law.
-
We have experience dealing with Insurance Companies. We can analyze an Insurance policy and determine what you are owed. We can show an Insurance company that you are not alone in figuring out your coverage. Guenin Law will assist you in getting the coverage you bargained for – the coverage you paid for.
-
We have had clients that were told that there was only $25,000 of coverage. The injuries our client suffered were much greater than $25,000. Our client’s doctor bills and lost wages would not even be covered by that amount. After litigating the issue in Federal Court, we successfully received an Order from the Judge telling the Insurance Company that its policy actually provided $2,000,000.00 in coverage for our client. Shortly thereafter, the case successfully settled. Our injured client received the compensation she deserved.
-
Don’t try to handle technical insurance disputes alone. The Insurance Company has hundreds, if not thousands of lawyers that work for them every day. You need and deserve knowledgeable and experienced lawyers that will work for you.

Other Services

Estate Planning
-
Emily assists clients with their estate planning needs. Two of the most critical estate planning documents are Wills and Power of Attorneys. A Will is a legal document that states how you would like your property divided after your death. Without a will the court will decide the outcome of your estate and determine any guardianship of minor children. A Power of Attorney appoints an individual to have the power to legally transact any or all of your business and to legally do or perform anything that that person may do, when physically or mentally capable, that they are personally unable to do.
